Agreement to These Terms

By accessing or using oupahome.com or any service provided by Oupa LLC (“Oupa”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use our website or services.

These Terms apply to all visitors, users, and anyone who accesses or uses oupahome.com, including the Stay or Move decision tool and any paid services Oupa may offer in the future.

Geographic Scope

Oupahome.com is intended for residents of the United States only. By using this service, you represent that you are a resident of the United States.

If you are located outside the United States — including in the European Union, United Kingdom, or Canada — this service is not currently directed at you. If you choose to use this service from outside the United States, you do so at your own risk and acknowledge that your information will be processed in the United States under US law.

We intend to expand our geographic scope and update these Terms to comply with applicable international laws when we actively begin serving users in other jurisdictions.

Who We Are

Oupa LLC is a Wyoming limited liability company. We operate oupahome.com, a digital platform providing housing decision guidance, information, and advisory services to help people think through decisions about where to live as life changes.

Our Services

Free Stay or Move Assessment

Oupa currently offers a free Stay or Move decision tool. By completing the assessment, you:

  • Answer 15 questions about your home, finances, support, lifestyle, and health
  • Provide your email address to receive your personalised report
  • Receive a structured report summarising your answers across five areas
  • Agree to receive a follow-up series of practical guides by email

The assessment is provided free of charge. No payment is required. You may unsubscribe from follow-up emails at any time.

Future paid services

Oupa intends to offer paid advisory and assessment services in the future, including a comprehensive home safety and environmental health evaluation. When paid services become available:

  • Pricing will be clearly stated before any purchase is made
  • Separate terms governing payment, delivery, and refunds will apply
  • No payment will be collected without your explicit consent

These Terms will be updated when paid services are introduced. You will be notified of material changes.

Refund policy for future paid services

Once a paid assessment or advisory service has been delivered to you, no refund will be issued. If you have paid for a service and it has not yet been delivered, you may request a full refund within 7 days of purchase by emailing hello@oupahome.com. Refunds at any other time are at Oupa’s sole discretion.

Not Professional Advice

This is one of the most important sections of these Terms. Please read it carefully.

Oupa provides information and structured guidance to help you think through housing decisions. Oupa is not a licensed financial advisor, legal advisor, medical professional, real estate agent, or any other regulated professional.

Nothing on oupahome.com, in the Stay or Move report, in our emails, or in any communication from Oupa constitutes:

  • Financial advice — including advice about mortgages, equity release, reverse mortgages, or any financial product
  • Legal advice — including advice about property rights, estate planning, or legal obligations
  • Medical or health advice — including advice about cognitive health, medication, or treatment
  • Real estate advice — including advice to buy, sell, or retain any property

The Stay or Move report is a structured summary of your self-reported answers. It reflects what you told us. It is a starting point for your own thinking — not a recommendation, a diagnosis, or a professional assessment.

Before making any significant housing, financial, legal, or health decision, you should consult qualified professionals appropriate to your situation. Oupa strongly encourages this.

You acknowledge that any action you take based on information from oupahome.com is taken at your own risk.

Intellectual Property

All content on oupahome.com is owned by or licensed to Oupa LLC. This includes:

  • The Stay or Move decision framework and scoring methodology
  • The report structure, templates, and language
  • All written content, guides, and educational materials
  • The Oupa brand name, logo, wordmark, and visual identity
  • All software, code, and technical infrastructure

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Oupa content without our prior written permission.

You may share your own personal Stay or Move report with family members or advisors for your personal use. You may not publish, sell, or distribute it to others.

Any feedback, suggestions, or ideas you submit to Oupa become Oupa’s property. We are free to use them without restriction or compensation to you.

Acceptable Use

By using oupahome.com, you agree not to:

  • Provide false or misleading information in the assessment
  • Use the service on behalf of another person without their knowledge or consent
  • Attempt to reverse-engineer, scrape, or copy our assessment methodology or scoring framework
  • Use automated tools to access or interact with the website
  • Interfere with or disrupt the security or functionality of the website
  • Use the service for any commercial purpose without our prior written consent
  • Attempt to access areas of the website you are not authorised to access

We reserve the right to suspend or terminate access for any user who violates these Terms.

Disclaimer of Warranties

OUPAHOME.COM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Oupa disclaims all warranties, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, completeness, or reliability of any content or report
  • Warranties that the service will meet your specific needs or expectations

The Stay or Move report is based entirely on the answers you provide. Oupa does not independently verify any information you submit. The accuracy of your report depends entirely on the accuracy of your answers.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUPA LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OUPAHOME.COM OR ANY OUPA SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID OUPA IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Oupa LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of oupahome.com or our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any information you submit that is false, inaccurate, or misleading

Third-Party Links and Services

Oupahome.com may contain links to third-party websites or services. These links are provided for your convenience and do not constitute endorsement. Oupa has no control over third-party content and is not responsible for it.

When Oupa recommends a contractor, service provider, or professional, we may have a commercial referral relationship with that provider. We will always disclose this. Oupa’s recommendations are based on our genuine assessment of fit for your situation — not solely on the existence of a commercial relationship.

We never receive referral fees from senior care facilities.

Privacy

Your use of oupahome.com is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of information as described in the Privacy Policy.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (if you have provided one) and update the “Last updated” date at the top of this document.

Your continued use of oupahome.com after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our services.

Termination

We reserve the right to suspend or terminate your access to oupahome.com at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

You may stop using our services at any time. If you have subscribed to our emails, you may unsubscribe at any time using the link in any email we send.

Sections of these Terms that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and governing law — will survive.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of oupahome.com shall be resolved exclusively in the state or federal courts located in Wyoming. You consent to the personal jurisdiction of those courts.

Before initiating any legal proceeding, you agree to contact us at hello@oupahome.com and give us 30 days to attempt to resolve the dispute informally.

Waiver of class actions

To the fullest extent permitted by applicable law, you waive any right to bring or participate in any class action, collective action, or representative proceeding against Oupa. Any dispute must be brought on an individual basis.

General Provisions

Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Oupa regarding your use of oupahome.com and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms freely.

No agency

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Oupa.
